Student Complaint Policies and Resolution

The New York Academy of Art makes every effort to resolve student complaints using policies and procedures outlined in the current Student Handbook. To comply with the regulations required under Title IV of the Higher Education Act of 1965, the Academy provides the following information to current and prospective students.

Institutions participating in federal aid programs must be legally authorized to operate within the state of location. Title 34 CFR §600.9 requires states to have a “process to review and appropriately act on complaints concerning the institution including enforcing applicable State laws.” Title 34 CFR §668.43(b)requires that institutions:

make available for review to any enrolled or prospective student upon request, a copy of the documents describing the institution’s accreditation and its State, Federal, or tribal approval or licensing. The institution must also provide its students or prospective students with contact information for filing complaints with its accreditor and with its State approval or licensing entity and any other relevant State official or agency that would appropriately handle a student’s complaint.

 

Procedures

Academic and Non-Academic Misconduct Students may report misconduct, both academic and non-academic, to the President, the Provost or the Faculty Chair. For details regarding the policies and procedures regarding academic and non-academic misconduct, refer to the Student Handbook.

Criminal Activity – Complaints involving matters of a criminal nature should be directed to the Director of Operations 212.842.5969 and/or the Police (1st Precinct, 16 Ericsson Pl, New York, NY 10013, 212-334-0611). In the event of an emergency, dial 911.

Family Educational Rights and Privacy Act (FERPA) refer to the Student Handbook.

Harassment or Discrimination – refer to the Academy’s Title IX Policy on Equal Opportunity, Harassment and Nondiscrimination page and the procedures outlined in the Student Handbook

Request for Grade Change & Grade Appeal – refer to the policies in the Student Handbook

Title IX – refer to the Academy’s Title IX Policy on Equal Opportunity, Harassment and Nondiscrimination page.

If an issue cannot be resolved by the Academy, students may file a complaint with their respective State Licensing Authority. These agencies should be contacted only after the student has registered a complaint using the Academy’s stated internal procedures and has not received a response to the request for resolution.
